Drama in Kentucky and "So help me God"

You've all heard by now what's going on in Kentucky.

Kentucky has commenced issuing marriage licenses to gay couples and clerk Kim Davis remains defiant while sitting in jail for not "doing her job"

Prior to serving as clerk or deputy, each must swear the following:
"I, ....., do swear that I will well and truly discharge the
duties of the office of .............. County Circuit Court clerk, according to the best of my
skill and judgment, making the due entries and records of all orders, judgments, decrees,
opinions and proceedings of the court, and carefully filing and preserving in my office all
books and papers which come to my possession by virtue of my office; and that I will not
knowingly or willingly commit any malfeasance of office, and will faithfully execute the
duties of my office without favor, affection or partiality, so help me God."
So help me God

Seems to me the oath invites conflict between State and Free Exercise of Religion.

Marriage licenses have been issued and the county clerk is still in the slammer.

"So help me God" reinforces the importance of the promise made in the oath; it doesn't modify the oath.

As in many areas, the Bible takes multiple positions regarding oaths. Most passages underline the importance of keeping oaths, however Jesus stated one should never make oaths, in fact they are evil. So one could say Kim Davis violated religious tradition by breaking that oath and she also violated Jesus' statement by making the oath in the first place.

Several humorous internet/facebook memes going 'round... One is to imagine what would happen if a Quaker held a Government job that involved issuing gun licenses and refused to do so because of his or her religious faith regarding pacifism. :btw: Quakers refuse to take oaths.

Another meme:

Religion: I can't eat pork.
Religious Liberty: I'm going to get a job at a place that serves pork and make sure your can't eat pork either.
