Here's what she can't do: Interfere with the other clerk's issuing marriage licenses.

Based on several of her lawyer's statements quoted above & below and depending on the strength of her desire to become a "martyr", it's possible she will continue to block marriage licenses, perhaps even declaring any license without her name is invalid. We'll see...
An attorney for jailed Rowan County Clerk Kim Davis said Friday that the marriage licenses issued by her deputies to several same-sex couples are invalid.

“They are not worth the paper they’re written on,” Matt Staver said outside the Carter County Detention Center, where Davis is being held on a contempt charge.

She'd have to physically prevent other reps from issuing marriage licenses.
Not sure about the legal validity of the claim any licenses granted with her name on it are worthless. (the courts would have to determine that)
But yeah, we will have to see.

Did she physically prevent the clerks who work for her from issuing licenses previously?

I expect any issuance of marriage licenses would violate her thrice divorced/2 children out of wedlock conscience. Plus she may stand to make a lot of money out of this. My hypothesis: shenanigans will ensue... :lol:

She didn't the first time. She would have to (now that they are issuing) this time around when she reports back to work.

I have to put aside her personal history because most people are hypocrites, religious and non religious alike.
Her hypocrisy is on display because she's on a spotlight she turned on. And, her personal history has nothing to do with the legality of this issue, which is my primary interest.

RFRA is also available as a shield to gays and lesbians.
(yes, there are "religious" gays and lesbians)

Turns out that the plaintiffs did not wish for Kim Davis to go to jail and the judge who sent her to jail did not have to.
There was sepculation that he had made up his mind to send her to jail without considering alternatives.

It's really hypocritical of the left to be crying about civil disobedience when the left has advocated it before if it aligns with what they want to happen
And the witch hunt from the left and the religiousl bigots calling for her to be thrown in jail was disgusting in a cult like way. Not even the gay couple plaintiffs wanted that to happen. It says a lot about their genuineness which I never doubted. Those that see themselves as their champions are really the monsters in all this. Theyre blood sucking thirsty to start a modern day witch hunt.

What a sad time.

She would not have to physically prevent her staff from issuing licenses - just threaten them with disciplinary action, withhold pay, or whatever negative actions she can take without touching anybody.

Sending someone to jail for a contempt of court citation is pretty standard operating procedure as far as I can tell. She was taking actions to prevent others from obtaining legal Gov't services, quite a bit different from civil disobedience. She could have avoided it all by refusing to personally issue licenses, but allowing her clerks to do so as is happening now.

Also, it would have avoided a media circus.

Yes, I agree she made a mistake by getting other city officials involved. Big mistake.
But again, it's not a standard procedure to throw an elected official in the slammer no matter what your personal desires might be becuase of the popularization of the issue.
We all can reasonably suspect that certain people with a particular worldview were praying (pun intended) for the worst for her.

She wont be able to stop it from happening.

I read that prior to all the mess, couples from different counties came to get their license from her office.
Apparently it was known just before that her office was going to turn away gay couples.
They went out of their way looking for a fight.

...In a phone call with Jackson County, Kentucky, Sheriff Denny Peyman and other local Oath Keepers activists, Rhodes said that he was on his way to Kentucky to help with the Davis operation.

...Rhodes said that the Rowan County sheriff should have blocked U.S. Marshals from detaining Davis, but since neither the sheriff nor the state’s governor will do their “job” and “intercede” on behalf of Davis, the Oath Keepers will have to do it instead. “As far as we’re concerned, this is not over,” he said, “and this judge needs to be put on notice that his behavior is not going to be accepted and we’ll be there to stop it and intercede ourselves if we have to. If the sheriff, who should be interceding, is not going to do his job and the governor is not going to do the governor’s job of interceding, then we’ll do it.”
