Assuming that the federal government pays for these headstones, is this a violation of the establishment clause?Even if it did violate the establishment clause, and I'm not at all sure it does, this would be one of those cases where free expression should trump establishment.
As a matter of interest, it's my understanding the VA even recognizes the symbol for American Atheists, Inc. for placement on headstones. This is not, by the way, an official symbol for atheists or atheism--no such symbol exists.
It's also worth noting that the ACLU has never objected to such markings on headstones--even though I've seen a few email hoaxes that suggested otherwise.
